Collaborative Divorce

A More Civilized and Effective Approach to Divorce

A relatively new approach to divorce, collaborative divorce proceedings offer individuals the chance to come to amicable and civilized agreements on the various issues relating to the dissolution of a marriage. Often more affordable and less emotionally draining than a court battle, the collaborative process allows a comfortable forum for divorcing couples to come to agreements that offer an increased chance for long term success while offering both parties the satisfaction of having an impact on the outcome of the divorce.

At the Hudson Valley Collaborative Divorce & Dispute Resolution Association, clients in Dutchess, Putnam and Westchester, New York, are afforded comprehensive support from experienced professionals throughout the collaborative divorce process, allowing for efficient and civilized resolutions to the complex issues relating to divorce.

Call or email a legal, financial, or mental health professional from our divorce team. Feel free to contact one of our professionals or email the Hudson Valley Collaborative Divorce & Dispute Resolution Association for general information.

Choosing a Different Path, Saving you Unnecessary Emotional and Financial Stress

Because collaborative divorces include no court appearances, clients choosing this approach often are more satisfied with the experience of going through a divorce as they feel they are more in control of the process. Collaborative divorce can be effective for individuals who are able to:

  • Treat each other with respect and honesty
  • Resolve disagreements with a settlement in everyone's best interests
  • Participate actively to create a system for future decision making
  • Negotiate an enduring agreement
  • Commit to providing for your children's needs

Getting Started

The first step in the process is to share information on collaborative divorce between spouses. This can be accomplished by sharing this web site or by contacting the collaborative divorce team and requesting an informational packet. Once the decision to proceed has been made:

  1. Each spouse selects an attorney from the list of Collaborative lawyers and a divorce coach from the list of mental health professionals. Contact either one to arrange an informational meeting to decide whether the collaborative divorce process suits you.
  2. Both spouses and their lawyers attend the first collaborative meeting to sign the Participation Agreement that governs the process. If temporary immediate measures are required to maintain stability during the negotiation process, these will be included in the agreement.
  3. Each spouse meets individually with their attorneys and divorce coaches to identify and discuss plans and particular issues relevant to the situation.
  4. Both spouses and counsel attend subsequent collaborative negotiations until an agreement can be reached.
